General Terms and Conditions

1. Orders taken and delivery
SD&C will take orders and deliver items selected in the shop to customers in all member states of the EU. SD&C will also deliver to international customers outside the EU member states, however accessories will only be delivered in connection with orders of entire age simulation suits, and orders must be over a certain minimum amount. When shipping to EU member states, normally a flat rate applies, when shipping to countries outside the EU, shipping costs are charged manually depending on distance.

2. Prices and taxation
Prices are in Euro and are stated as net price per unit not including taxes (VAT). VAT will not be charged on deliveries within Europe, if a EUID (VAT-number) can be presented. Worldwide customers are responsible for their country’s import customs expenses while SD&C takes care of all necessary export declarations and costs. Prices declared in offers stay valid over price changes in catalogues or on webpages.

3. Transportation and insurance
SD&C insures deliveries along the transport route. If goods arrive damaged, they can be sent back. However, SD&C is not liable for damages as a result of a late shipment.

4. Changes
SD&C reserves the right to make product changes without prior notice. Should SD&C be unable to deliver certain individual components, we reserve the right to deliver a spare part item of the same value or we may turn down the order.

5. Use of the goods and liability
The goods are intended for commercial and institutional customers. When placing an order, the customer thus confirms that the goods will be used for commercial or institutional use. The user is responsible for using the goods properly. Commercial rental and loaning of the goods are prohibited. SD&C does not assume responsibility for any damage caused by the use of the simulation equipment.

6. Payment conditions
SD&C requests payment prior to delivery. All goods remain the property of SD&C until completely paid. Invoices are immediately payable without deduction. In case of deviating agreements, the payment agreement printed on the invoice is valid.

7. Rentals
Rentals must be requested by an email to SD&C specifying the intended date and delivery address. Rental times of Senior Suits are counted by days and do not include delivery times. By his signature the customer agrees to handle a rented SD&C Senior Suit with care and to have it packed and ready for return on the first day after the agreed rental time. SD&C may treat every day of delay like an additional renting day. For a lost suit the price of a new suit has to be paid by the customer. The customer must take full responsibility for all aspects of employing the age simulation and for its consequences. Persons in an age simulation suit have strongly restricted abilities and must be protected by the customer. The rental fee must have arrived before a Senior Suit is shipped. The rental fee can be accounted for if a customer later decides to buy a Senior Suit from SD&C.

8. Cancellation
If the customer cancels a rental 2 weeks before the agreed date or if a workshop or a supported event is cancelled shorter than 4 weeks before the agreed date, a cancellation fee of 25% may be charged. Should a rental delivery from SD&C be late due to unforeseeable reasons, the customer may send the delivery back unopened and will receive a full refund of the rental fee.

9. Court of jurisdiction
Court of jurisdiction is Ingolstadt in Bavaria, Germany

10. Effectiveness
The terms and conditions of business shall become effective once an order is placed. Should one or more conditions be invalid, this shall not affect the overall validity. We cannot accept deviating conditions from the customer, even if we do not expressly object to them. Incidentally, the regulations from European legislation shall apply in their respective versions for all terms and conditions of business not covered in the terms and conditions. If in doubt of the translation, the German language version is valid.
